$14M Lawsuit Against Costco Over Traumatic Brain Injury

Santa Rosa, California — A Northern California resident, Sadie Novotny, has filed a $14 million lawsuit against Costco Wholesale Corporation, alleging that the company’s negligence caused a liquor cabinet to fall on her during a visit—resulting in a permanent traumatic brain injury (TBI) along with other physical and emotional damages.

What Happened Inside Costco?

The incident occurred on March 22, 2024, while Novotny was shopping for a liquor cabinet at a Costco location in Santa Rosa. According to the store’s report, the cabinet—positioned atop a worn wooden pallet—fell suddenly without warning. While she managed to soften part of the impact, she sustained immediate injuries to her shoulder, right arm, fingers, lower back, and head.

The lawsuit claims the cabinet was unstable and dangerous, resting on thin legs, and that Costco failed to properly secure the item or train employees on safe display practices.

Legal Claims and Allegations

Novotny’s complaint includes several causes of action:

  • General negligence: for failing to maintain a safe environment for customers
  • Premises liability: as the injury occurred on Costco’s property
  • Product liability: as the cabinet was allegedly defective or improperly displayed

She is seeking the following damages:

  • $5 million for pain, suffering, and emotional distress
  • $2 million for future medical expenses
  • $2 million for loss of earning capacity
  • Over $100,000 for past medical expenses and home care services

What Is a Traumatic Brain Injury (TBI)?

TBIs can be invisible but deeply life-altering. They can affect memory, behavior, mood, and overall quality of life. According to the CDC, even a mild concussion can lead to long-term neurological effects if not treated promptly.
