Los Angeles, California — Cedars-Sinai Medical Center has agreed to a nearly $6.5 million settlement in a case involving a 20-month-old girl who sustained a severe brain injury during her birth in 2023. The lawsuit, filed by the child’s parents, Shoshona and Adam Primack, alleged that medical negligence during the delivery led to the injury.
The settlement, approved by Los Angeles Superior Court Judge Tony L. Richardson, will provide the child approximately $3.47 million after legal fees and expenses.
According to the lawsuit, the attending gynecologist had promised to supervise the delivery but left the procedure in the hands of two residents. The doctor arrived only after the child was born limp and unresponsive following a vacuum-assisted delivery.
The plaintiffs argue that this lack of supervision during a critical delivery resulted in their daughter’s lifelong need for medical care. The lawsuit claimed that the child would require extensive medical treatment for the foreseeable future due to the brain injury.
Cedars-Sinai denied liability, asserting that any harm suffered by the child was unrelated to the hospital’s actions and could be attributed to the family’s negligence. Hospital attorneys also argued that the case should have been handled under workers’ compensation.
