4-Year-Old Child Dies From Brain Injury After Falling on a Tree Branch

The San Diego community is in mourning following the death of Ronan Kerr, a four-year-old boy who suffered a traumatic brain injury after a large tree branch fell onto his head while he was playing in a public park with his family.

The tragic incident occurred in June, but renewed public outrage erupted this week after the child’s parents filed a lawsuit against the City of San Diego, alleging negligence in the maintenance of trees in public spaces.

What Happened?

According to the lawsuit, a branch measuring more than 30 feet long broke off from a height exceeding 60 feet, striking Ronan directly on the head while he was with his father and older brother.

Although the father attempted to shield his children, Ronan suffered:

The child was rushed to the hospital for emergency treatment, but passed away seven days later due to the severity of his injuries.

Parents Allege City Negligence

Ronan’s parents accuse the City of San Diego of wrongful death due to negligence, alleging that the tree:

  • Was dead, dry, and diseased
  • Showed visible signs of deterioration
  • Had not received proper maintenance from municipal services

The lawsuit states that the size and weight of the branches and trunk made the collapse foreseeable and preventable.

In addition to financial compensation, the family is demanding that the city remove or repair dangerous trees in public parks to prevent similar tragedies in the future.

Legal Context: Government Liability for Brain Injuries

California law clearly addresses safety obligations in public spaces.

Under California Government Code §835, a public entity may be held liable if:

  • A dangerous condition existed on public property
  • The entity knew or should have known about the danger
  • Reasonable steps were not taken to correct the condition

When a traumatic brain injury or the death of a child occurs due to poor maintenance, families may seek compensation for:

  • Medical and hospital expenses
  • The child’s pain and suffering
  • Funeral and burial costs
  • Long-term emotional and psychological harm

Why Brain Injuries in Children Are Especially Devastating

Traumatic brain injuries in young children are particularly severe because the brain is still developing. Even a single impact can cause:

  • Permanent cognitive impairment
  • Emotional and behavioral changes
  • Loss of future abilities and opportunities
  • Irreversible consequences for the entire family
