Two Killed in Fiery Wrong-Way Crash on Highway 395

2 Killed in Wrong-Way Head-On Crash on U.S. 395

Two people were killed Sunday night in a wrong-way crash on U.S. Highway 395 near the California-Nevada state line.

The crash was reported shortly after 7:30 p.m. Callers told authorities a vehicle was driving southbound in the northbound lanes near Bordertown.

Minutes later, a head-on collision was confirmed.

Vehicles Engulfed in Flames

Witnesses reported flames immediately after impact.

Emergency responders arrived to find:

  • One person has died inside a vehicle
  • CPR is being performed on a second victim
  • At least one vehicle is on fire

Both vehicles — a Hyundai Santa Fe and a Subaru — suffered severe front-end and fire damage.

All northbound lanes were closed during the investigation.

Why Wrong-Way Crashes Are So Deadly

Wrong-way crashes are among the most severe roadway collisions.

They often involve:

  • Full-speed impact
  • Direct front-end collision
  • Little to no braking time
  • Secondary fire risk

These crashes frequently result in:

Even when victims survive the initial impact, catastrophic head injuries are common due to extreme force.

Liability in a Wrong-Way Crash

Investigations typically examine:

  • Driver impairment
  • Confusion at on-ramps or exits
  • Missing or inadequate signage
  • Lighting conditions
  • Road design issues

If a driver entered the highway incorrectly, negligence may apply.

If roadway design or signage contributed, liability could involve a public entity under California Government Code § 835.

Commercial or third-party vehicle involvement may also expand responsibility.

Wrongful Death Rights in California

When a crash results in death, surviving family members may file a claim under California Code of Civil Procedure § 377.60.

Compensation may include:

If a victim survived briefly before passing, a survival action (§ 377.30) may allow recovery for medical expenses and suffering prior to death.

Brain Injuries in High-Impact Collisions

Head-on crashes often cause:

  • Traumatic brain injury (TBI)
  • Diffuse axonal injury
  • Skull fractures
  • Severe concussions

These injuries can be fatal or permanently disabling. Even survivors may require lifelong medical care.
