Toddler’s Brain Injury Prompts Boat Safety Lawsuit

Florida — A lawsuit has been filed against Bombardier Recreational Products and Jacksonville Power Sports following a boating accident that resulted in a severe brain injury to an 18-month-old girl.  The incident occurred in August 2024 on Black Creek when the family’s Sea-Doo Switch flipped, trapping Vianca Grullon underwater.

The lawsuit alleges that a design flaw in the vessel contributed to the accident. The plaintiff’s attorney stated that the boat takes on excessive water in the bow, creating instability. He emphasized that the accident was preventable and sought to compel Bombardier to prioritize safety in its designs.

Rosen clarified that alcohol was not a factor in the incident; Vianca was wearing a life jacket, and her father was operating the boat in a no-wake zone. Despite these precautions, the vessel capsized, trapping Vianca for 20 minutes.

The accident has drastically altered Vianca’s life. She now requires feeding tubes and oxygen tanks. Rosen described the profound impact on the family, which now focuses on providing Vianca with the extensive medical care she needs. The family has not returned to the water since the accident.
