Traumatic Brain Injury Alleged in California ATV Lawsuit

Santa Ana, California — An Orange County jury is deciding whether alleged defects in a Yamaha off-road vehicle caused a 2019 rollover that left a driver with a fractured neck and a traumatic brain injury. The case features conflicting accounts of the crash, the vehicle’s design, and the extent of the driver’s long-term injuries.

John Van Camp filed a product liability lawsuit against Yamaha after his 2016 Yamaha YXZ1000R rolled forward while he was driving with his son near Glamis Flats in 2019. Van Camp alleges that the vehicle’s rear suspension caused it to buck forward and that its rollover protection system failed during the crash.

His attorneys say the collision resulted in a fractured neck and a permanent traumatic brain injury. They are seeking up to $115 million in compensatory damages, as well as potential punitive damages.

Yamaha disputes those claims. The company argues that Van Camp struck a sand berm while traveling approximately 30 miles per hour and that driver conduct—not a defective design—caused the rollover. The defense also challenges whether he sustained a brain injury.
